If a land parcel is jointly owned marital property, its sale requires properly documented mutual agreement. Where one spouse concludes the transaction, notarised consent from the other spouse is provided in the circumstances required by law. If the parcel is the seller’s separate property, the supporting documents must establish that status. A register entry in only one name does not, by itself, settle the question.
Before committing to a completion date, establish when the right arose, how it was acquired and which records substantiate the property regime. The answer depends on the parcel’s history, rather than the seller’s current marital status alone.

01
Start with the asset and its acquisition history
This guide principally concerns an established agricultural land parcel with a cadastral number. A certificate representing a land-share entitlement, an inheritance being documented and a registered parcel are different legal situations. If the asset itself is unclear, start with the documents establishing the right.
Article 60 of Ukraine’s Family Code establishes a presumption of joint marital ownership for property acquired during marriage. Article 57 identifies categories of separate property. A Ukrainian notary checks those rules against the acquisition documents, dates and circumstances. A seller’s explanation alone may not resolve a disputed ownership position.
Buying land during marriage and inheriting it during marriage are different acquisition routes. The date of a newly issued register extract is not necessarily the date on which ownership was acquired. Do not infer the property regime from a single register field.
02
A scenario table for the initial review
This table identifies what needs checking; it is not a determination of an individual parcel’s legal status.
| Situation | What to check | Records for the initial discussion |
|---|---|---|
| Acquisition before marriage | Acquisition date and basis; any later change to the property regime | Acquisition document, marriage records and relevant agreements or decisions |
| Purchase during marriage | Source of funds, marital-property regime and agreements between the spouses | Purchase contract, ownership records, marriage documents and applicable agreements |
| Inheritance | Which person inherited which right and whether documentation is complete | Inheritance certificate and records of the parcel right |
| Gift during marriage | Identity of the recipient, subject of the gift and subsequent changes to rights | Gift contract and current ownership records |
| Purchase with separate funds | Evidence of the source and use of those funds; whether funding was mixed | Contract and relevant evidence of the source and movement of funds |
| Marriage or other agreement | Whether it covers the parcel and affects ownership or disposal | Applicable agreement and relevant amendments |
| Sale following divorce | Whether joint ownership remains and whether division was properly documented | Divorce record, division agreement or court decision and ownership records |
| Dispute over ownership status | Nature of the disagreement and the lawful route to resolving it | Existing claims, agreements, court decisions and other evidence for counsel and the notary |
For land obtained through privatisation or land-share allocation, do not automatically use the “purchase during marriage” scenario. Article 57 contains specific provisions concerning certain forms of land privatisation. The actual acquisition basis, date and rules applicable at that time need review.
03
Why a single registered owner does not settle marital ownership
Documents issued in one spouse’s name are not the same as evidence that the land is separate property. Paragraph 4.2 of Chapter 1, Section II of the Notarial Procedure expressly addresses jointly owned marital property documented or registered in only one spouse’s name.
Review the chain: acquisition basis → acquisition date → marital status at the relevant time → applicable agreements or decisions → current ownership records. Receiving rent into one person’s account or communicating with the tenant alone does not conclusively establish sole ownership either.
Disclose a previous marriage where relevant. A parcel acquired in an earlier marriage may require records relating to that period even if the seller is currently unmarried or has remarried.
04
What form should the consent take?
Under Article 65 of the Family Code, consent for a contract requiring notarisation and/or state registration must be in writing and notarised. A message, verbal agreement or signature on an informal sheet should not be treated as a substitute.
Ukraine updated its notarial consent rules in 2026. Before executing the consent, agree its subject, wording, required particulars and compatibility with the proposed sale with the notary who will handle completion. This is especially useful if another notary will certify the consent in advance.
If the consent names a particular buyer or specifies disposal terms, the notary checks compliance with those conditions. If the buyer, price or another stated condition changes, submit the revised terms for review. Do not assume that an earlier document automatically covers a different transaction.
Consent is not a power of attorney. It does not itself authorise someone to sign the sale contract on the owner’s behalf. Any representative’s authority needs separate documentation and review.
05
When separate ownership may allow a sale without spousal consent
Paragraph 4.4 of the Notarial Procedure allows a transaction to be certified without the other spouse’s consent where the documents establish separate ownership. Relevant bases include acquisition before marriage, inheritance, a gift, purchase with separate funds or an applicable agreement between the spouses.
The seller’s practical task is to prepare the evidence, rather than declare that consent is unnecessary. For separate funds, that may require evidence both of their origin and their use to acquire this parcel. Mixed funding or objections from another person call for individual review.
For inheritance documentation, see: selling inherited agricultural land.
06
Divorce does not automatically divide jointly owned property
Article 68 of the Family Code states that divorce does not terminate joint marital ownership of property acquired during marriage. A divorce certificate or judgment is not automatically an agreement dividing a parcel.
Establish whether division occurred, what the agreement or court decision provides and how the resulting rights are documented. If there was no division, the notary needs to establish the appropriate disposal procedure and participation of the relevant people. Do not promise an individual sale merely because the marriage has ended.
07
Five steps before agreeing final sale terms
- Locate the acquisition document. Outcome: the asset, acquisition basis and relevant date are clear.
- Assemble the marital-property records. Outcome: a coherent history of relevant marriages, divorce, agreements, inheritance or gifts is available.
- Arrange the notary’s review. Outcome: the required documents, participants, consent or other steps are identified for the actual situation.
- Agree the form and wording of consent, if required. Outcome: the document matches the asset and proposed terms. Where a buyer or price is specified, check those details before execution.
- Reconcile the final terms with the rest of the transaction. Outcome: marital ownership, leases, encumbrances, possible pre-emption rights, buyer eligibility and payment are addressed through the proper process. Refer changed terms back to the notary.
A working document checklist is available at documents for selling agricultural land. Do not post passports, marriage certificates or complete title documents in public comments or open forms. Initially describe the situation briefly and agree a secure document-sharing channel separately.
08
Keep three separate questions distinct
Spousal consent concerns the marital-property regime. Participation of co-owners and the sale of a defined ownership share concern the structure of co-ownership. Pre-emption is a separate question that can arise when selling an ownership share or agricultural land. Satisfying one requirement does not replace the others.
If the transaction concerns an ownership share, see selling agricultural land in co-ownership. Spousal consent is not a universal clearance for the transaction: it does not remove encumbrances, terminate a lease or establish that a particular buyer is eligible to acquire agricultural land.
Tax and evidence of payment require their own checks: taxes when selling agricultural land and safe payment for agricultural land.
09
Common mistakes
- Treating a single name in the register as conclusive evidence of separate ownership.
- Confusing the extract’s issue date with the acquisition date.
- Assuming divorce also divided the property.
- Reusing consent without checking its named buyer and conditions.
- Confusing consent with a representative’s authority or pre-emption.
- Promising an unconditional completion date before the document review.
Frequently asked questions
Is consent needed if the parcel is registered only in my name?
That fact alone does not resolve the issue. If the parcel is joint marital property, registration in one name does not remove the other spouse’s rights. The notary reviews the acquisition basis, date and supporting documents.
Is consent needed for inherited land?
Inheritance is a statutory basis for separate property. Nevertheless, the notary must establish which right you inherited, whether it is properly documented and whether other relevant circumstances affect this parcel.
What if the parcel was gifted to me during marriage?
A gift to one spouse can also establish separate ownership under Article 57. Present the gift contract and current records. Being married when the gift was made does not automatically make it joint property.
Does divorce end joint ownership?
No. Divorce alone does not terminate joint ownership of property acquired during marriage. Check whether division or another change of rights was documented. The sale procedure follows the actual rights, rather than marital status alone.
Can consent be executed separately from the sale contract?
Consent can be certified as a separate notarial act. Before execution, agree the wording with the notary who will handle the sale so that it corresponds to the proposed transaction, conditions and legal requirements.
What if the consent specifies a buyer or price?
The notary checks compliance with the stated conditions. If the deal changes, do not rely on the document mechanically. Ask whether it covers the revised transaction and what needs to be amended or executed again.
Which documents establish separate ownership?
Depending on the acquisition route, these may include a document establishing pre-marriage acquisition, an inheritance certificate, a gift contract, an applicable agreement between the spouses or evidence of separate funds. The complete list follows a review of the acquisition history.
How is joint marital ownership different from selling a defined share?
In joint ownership without defined shares, the respective fractions are not established in advance. In fractional co-ownership, each owner has a defined share in the right, which is not automatically a separately bounded piece of the field. Establish the asset being sold and its procedure before negotiations.
