If the record shows a seizure, mortgage or disposal restriction, see our guide to reviewing encumbered agricultural land before a sale.
There is no identical document package for every seller. The basic set covers identity, title and accurate cadastral data. Additional items depend on leases, inheritance, marital status, representation and encumbrances.
Select a notary and submit copies for preliminary review before ordering certificates. The notary confirms the exact transaction-specific list.
01 · BASIC PACKAGE
What an owner normally prepares
- passport or another identity document;
- Ukrainian taxpayer number;
- the document under which title was acquired;
- current information confirming registered ownership;
- cadastral number and State Land Cadastre extract;
- bank details for cashless settlement.
Depending on the history, title evidence may be a state land act, agreement, inheritance certificate or court decision. The decisive issue is the seller’s valid and registered title.
02 · TITLE AND CADASTRE
What to reconcile before closing
The parcel must be registered in the State Land Cadastre and have a cadastral number. The notary also checks title and encumbrances in the State Register of Rights.
01 The owner’s identity must be consistent across the documents.
02 Area, cadastral number, location and designated use must not conflict.
03 If there is no cadastral number, land-management documentation and registration come first.
Resolve discrepancies before setting a closing date because cadastral and registration corrections may take time.
See our guide to checking conflicting parcel area, boundary and cadastral records before a sale.
03 · LEASED LAND
Collect the full lease history
A lease normally does not prevent sale but changes the process. Prepare the lease, every amendment and current registration information.
- term and renewal provisions;
- rent, indexation and payment status;
- amendments changing parties or material terms;
- the process for the tenant’s pre-emption right.
04 · ADDITIONAL DOCUMENTS
Inheritance, marriage and representation
Inherited land
The heir needs an inheritance certificate and registered ownership. A sale cannot proceed while inheritance or title registration remains incomplete.
Marital status
The notary checks when and how the land was acquired. A marriage or divorce certificate and notarised spousal consent may be required depending on the property regime.
Sale through a representative
A properly drafted power of attorney is required. For a foreign-issued document, agree the wording, authority, translation, apostille or legalisation with the Ukrainian closing notary in advance.
Co-ownership, encumbrances, minors and other unusual circumstances may require further documents or permissions.
05 · VALUATION AND TAX
What to confirm before notarisation
Depending on the transaction and tax basis, the file may require normative monetary valuation information, an electronic valuation certificate or a registered valuer’s report. Confirm the required document with the notary.
Disclose all real-estate sales in the current year and how the land was acquired. See Taxes When Selling Agricultural Land in Ukraine.
06 · BEFORE VISITING THE NOTARY
A sequence that reduces delay
- Select a notary
Share copies and explain how the land was acquired, its lease, marital status and any representation.
- Reconcile both registers
Check that the land cadastre and registered-rights data agree.
- Review the lease
Collect the agreement and amendments and establish the pre-emption process.
- Confirm valuation and tax
Agree the valuation document, rates, deadlines and payment route.
- Approve the final package
Set the closing date only after the notary clearly confirms the required documents.
Common reasons preparation stops
01 No cadastral number or parcel formation.
02 Conflicting area, address or designated-use data.
03 Unregistered title or incomplete inheritance.
04 Missing lease amendments.
05 A power of attorney drafted without the closing notary’s prior review.

Frequently asked questions
Is a cadastral number required?
Yes. The parcel must be registered in the State Land Cadastre and have a cadastral number. If it does not, land-management documentation and registration are required first.
Is a state land act sufficient?
Not always. It may evidence the basis of title, but the notary also checks current ownership records, cadastral data, encumbrances and document consistency.
Is spousal consent required?
It depends on when and how the land was acquired, the owner’s marital status and the property regime. The notary determines whether consent is needed and in what form.
Can the owner sell while abroad?
Often yes, through a representative. The power of attorney, authority granted, translation, apostille or legalisation should be agreed with the Ukrainian closing notary before execution.
What documents are needed for leased land?
The lease, every amendment and current registration details are required. The term, rent, renewal and tenant pre-emption right should also be reviewed.
What is needed for inherited land?
A certificate of inheritance and registered ownership are required. The tax treatment of inherited property should be checked separately before closing.
