You own a Ukrainian agricultural parcel, but a registry search reveals a seizure, mortgage or restriction on disposal. The first step is to identify the exact entry, the document behind it, its current status and the party authorised to resolve it. A repaid loan or an old court case does not, by itself, prove that the registered restriction has ended.
This guide concerns a formed agricultural parcel with a cadastral number and registered ownership. If you hold only an unallocated land-share right, the preparation differs. For the ordinary sale file, see our document checklist.
01
Different records call for different action
An encumbrance can restrict disposal or use of property. A registered lease is also relevant to a sale, but it should not be treated as a seizure.
| Entry or right | Practical consequence | Who confirms the route | Documents to collect |
|---|---|---|---|
| Seizure or attachment | Disposal may be restricted. Do not assume an ordinary notarised sale can proceed while the entry remains unresolved. | The closing notary checks the register; the competent enforcement authority or court addresses the underlying measure within its powers. | Current registry information, the enforcement order or court ruling, case number and any evidence of performance. |
| Mortgage | The land secures an obligation. The mortgage agreement, mortgagee’s position and the lawful sale or discharge mechanism require review. | Mortgagee, notary and the parties’ legal advisers. | Mortgage and loan documents, confirmed outstanding obligation, written mortgagee documents and registry data. |
| Disposal restriction | The label indicates a limit on the owner’s ability to dispose of the property; its source and termination requirements must be established. | Notary and the person or authority behind the entry. | The underlying instrument and any legally required consent or evidence of termination. |
| Lease | The tenant’s use right normally survives a change of owner. A statutory pre-emption process may also apply. | Notary, lessor, tenant and their advisers where needed. | Lease, amendments, registration details, rent record and notices. |
The table is a screening tool, not a legal determination for your parcel. Ukraine’s Law on State Registration of Rights governs registry information, while the Law on Mortgage contains specific rules for dealing with mortgaged property.
02
Check the record, its source and the parcel
Obtain current information from the State Register of Rights to Real Estate using the parcel and ownership details. Check the cadastral number, owner, type and date of the entry, registration reference and underlying document. The official Diia service guide explains access to current and archival register information. An older entry may require further document tracing with the notary.
Compare the State Land Cadastre description and your title document with the rights register. The cadastre identifies the parcel; the rights register shows ownership, other registered rights and encumbrances. If the parcel details disagree, read our guide to cadastral discrepancies. If it is leased, the leased land sale guide covers the separate pre-emption question.
Do not rely on a creditor’s informal message, a screenshot or an old extract. Match the evidence that an obligation was discharged to the present register status. Ask the notary which instrument and registration step are needed for the proposed sale. A mistaken or obsolete entry may be correctable, but the route depends on its legal basis; a simple owner request is not a universal remedy.
03
A workable sequence for the owner
- Collect the core file. Prepare the cadastral number, title document, current registry information, agreements and the instrument that explains the restriction.
- Speak with the closing notary early. Send copies for preliminary review. Ask whether notarisation is possible on the present record and what evidence must be available before a date is fixed.
- Identify the source. For a seizure, establish the authority, proceeding and order. For a mortgage, establish the lender, secured obligation, mortgage terms and written consent or discharge process.
- Resolve the issue through the competent party. Obtain the necessary instrument and confirm any required registry update. Do not pay anyone for a promise to “erase the entry” without a proper legal basis.
- Then agree commercial terms. Explain the preparation status honestly to a potential buyer; do not present a pending release as complete.
The legal route for an enforcement seizure depends on the proceeding. A court-ordered restriction requires examination of the ruling and the applicable procedure. Ukraine’s legal aid service explains that seizure and a later enforcement sale are distinct steps. It does not mean that an owner can privately transfer a seized parcel.
04
Price, timing and closing conditions
A restriction can affect the closing schedule, buyer diligence, settlement sequence and the group of buyers willing to engage. For a mortgage, a buyer will want documentary clarity on the secured amount, who issues consent or release documents, and how settlement will align with notarisation. For a seizure, the first question is whether there is a lawful and documented route to closing. No standard price discount or release deadline can responsibly be promised without the file.
Do not sign a statement that the property is free of restrictions when the current records do not support it. Any payment before completion should be structured with the bank, notary and legal advisers. See our guide to receiving payment safely.
05
What a buyer should request
Ask for current parcel and rights information, the instrument that created the entry, the written position of the competent creditor or authority, evidence of any lawful discharge or consent, and the notary’s review before signing. A proposed acquirer’s eligibility under Article 130 of the Land Code is a separate check. If there is a lease, check the pre-emption procedure as well. Openness about the documents does not itself remove a registered restriction.
06
Pre-review checklist
- Cadastral number and title document.
- Current register information covering ownership, other rights and encumbrances.
- Land Cadastre information and an explanation of inconsistencies.
- Order, judgment or instrument behind a seizure, restriction or mortgage; case reference.
- Loan and mortgage documents, creditor letters and evidence of discharge where relevant.
- Lease and amendments where the parcel is tenanted.
- Written questions for the notary: can the sale proceed now, which document is needed, who issues it and what registry step must be completed?
LANDMARKET takeaway
LANDMARKET can make a preliminary assessment and help organise the information needed for a land sale. The assessment does not replace a notary’s, creditor’s, enforcement authority’s or court’s decision on a restriction.

Can I sell if the register shows a seizure?
Do not schedule an ordinary sale until the closing notary has reviewed the entry and its underlying authority. A claim that a debt was paid does not replace the proper document and a current registry check.
Can mortgaged agricultural land be sold?
The answer depends on the current law, mortgage agreement, mortgagee’s written position and the way the secured obligation will be addressed. Agree the route with the mortgagee and notary before accepting money or promising a completion date.
Where can I check a restriction on a parcel?
Request information from Ukraine’s State Register of Rights to Real Estate, then match the result to the cadastral number and title documents. Historical records may need review. The notary performs a transaction-specific check before completion.
Is a lease the same as a ban on disposal?
No. A lease gives the tenant use rights and normally continues when ownership changes; agricultural land may also trigger pre-emption rules. A disposal restriction limits the owner’s power to transfer the property. Each requires its own review.
What should I send to the notary for an initial review?
Provide the cadastral number, title evidence, current register information, the document behind the restriction and any loan, mortgage, enforcement or lease papers. The notary will confirm the remaining requirements for that parcel and transaction.
